Customer terms, trading and IP notice

Clear rules before money or vehicle content changes hands.

Last updated 4 September 2026. These terms apply to the live MOTOLYST managed service. By requesting work or paying for a service pack, the client confirms that it has read these terms. Mandatory rights under South African law remain protected.

Who you contract with

MOTOLYST AUTOMOTIVE is the trading name of Christopher Botha, a South African sole proprietor. Business, privacy and formal electronic notices may be sent to Christopher.hotrod@gmail.com. A physical or service address will be supplied to a contracting client before final acceptance of paid work or on lawful request.

How an order is accepted

A form submission, quotation request or Yoco payment is a request to buy—not automatic acceptance. A contract begins only when MOTOLYST confirms the scope and acceptance in writing. If MOTOLYST cannot accept a paid request, the payment will be refunded in full to the original payment method.

Starter Pack scope

The R2 500 Starter Pack is a once-off purchase for up to 10 accepted vehicle sales packs. It does not renew automatically. Work outside that scope, urgent work, on-site capture, advertising spend and third-party portal charges require a separate written quote and approval.

Client responsibilities

The client must supply accurate vehicle facts, lawful instructions and usable source material; identify known defects and material uncertainties; and nominate an authorised approver. Turnaround begins only after the required inputs pass the quality gate. The client remains responsible for checking and approving every fact, price, finance statement and offer before publication.

Photos, brands and permissions

The client confirms that it owns or is authorised to provide the photos, videos, logos, vehicle information and personal information it submits, and that MOTOLYST may process them to perform the service. The client must not submit unlawful, misleading, infringing or confidential material without authority.

Payment, cancellation and refunds

Yoco processes card and supported payment details under its own terms; MOTOLYST does not receive card numbers. Statutory consumer rights, including any applicable cooling-off or cancellation right, are not excluded. Before work starts, an accepted paid order may be cancelled for a refund less only any lawful, reasonable charge. After work starts at the client’s request, any refund is based on the undelivered portion and applicable law. If MOTOLYST materially fails to deliver the accepted scope, the affected undelivered work will be corrected, re-performed or refunded as required by law.

No vehicle, finance or sales guarantee

MOTOLYST provides content-production support, not a mechanical inspection, roadworthy certificate, valuation, auction service, financial advice, credit approval or legal compliance sign-off. No listing position, enquiry level, sale price, buyer, bidder or vehicle sale is guaranteed. Visible damage is not intentionally hidden and uncertain facts are flagged for client confirmation.

Ownership and licence

The client keeps ownership of its supplied materials. Once the relevant fees are paid, the client receives a non-exclusive licence to use the delivered vehicle-specific assets for its lawful business marketing. Christopher Botha retains MOTOLYST branding, source code, methods, prompts, quality rules, reusable templates and general know-how. No licence to those underlying assets is granted by viewing the site or buying a pack.

Liability boundary

Nothing excludes rights or liability that South African law does not allow to be excluded, including liability that cannot lawfully be limited for gross negligence. To the extent the law permits, MOTOLYST is not liable for indirect or consequential loss, lost profit, platform decisions or losses caused by inaccurate client information, unauthorised material or client changes. Any permitted aggregate liability for a claim is limited to the fees paid for the affected service.

Third-party services and names

Yoco, vehicle portals, social networks and auction platforms are independent third parties with their own terms and availability. Their names and marks belong to their owners. Unless confirmed in a signed agreement, MOTOLYST does not claim affiliation, endorsement, direct publishing access or system integration.

Partners and commissions

No referral or capture commission is earned without written MOTOLYST partner terms. Commission is payable only after cleared client funds, to the approved business or contractor, and after refunds, taxes and pass-through costs are excluded. Hidden inducements and undisclosed conflicts are prohibited.

Complaints, law and changes

Email a complaint to Christopher.hotrod@gmail.com and include the order details and requested remedy. The parties should first try to resolve it in good faith. South African law applies, subject to any mandatory consumer forum or jurisdiction. The terms in force when an order is accepted govern that order; material changes do not rewrite an already accepted order without agreement.

Owner protection still requiring professional completion

Website wording cannot make a business risk-free or grant ownership of a general idea. Before high-volume trading, obtain a South African attorney’s review, record a dedicated service address, complete trade-mark clearance and use signed client, contractor and partner agreements.
